Helping You Help Your Loved One

At Rogers, Habas & Eisen, P.C., we provide experienced estate planning guidance to individuals and families throughout Rockland County and in surrounding New York and New Jersey communities.

Many of our clients face special estate planning needs due to having a loved one who suffers from a physical or mental health impairment. We draw upon decades of estate planning experience to help these caring people establish the legal instruments they need to continue supporting and caring for family members with special needs.

Establishing The Legal Documents You Need

If you are seeking to improve the life of a loved one with special needs, some of the estate planning options available to you include:

  • Special needs trusts: If a loved one is dependent upon public benefits such as Medicaid or Supplemental Security Income (SSI), you can use a special needs trust to provide them with additional financial resources. This trust can provide them with money for entertainment, travel, hobbies and other life-enhancing activities without rendering them ineligible for the government programs they rely upon.
  • ABLE accounts: By establishing an ABLE account, you can generate investment income that is not taxed, allowing you additional funds to pay for disability-related expenses.
  • Guardianships: When a child with special needs turns 18, his or her parents may need a legal guardianship to continue making important decisions over that child’s life. We can help you establish a guardianship over a loved one or represent your interests in contested guardianship proceedings.
